Supplemental Terms of Use & Safety Disclaimers

Yip - Dog Whistle ("Yip", "the app") is made by Mosaic Paradigm LLC ("Mosaic Paradigm", "we"). Apple's standard Licensed Application End User License Agreement governs the licensing and use of the app through the App Store. These Supplemental Terms provide additional product-specific safety, acceptable-use, and website terms. If these Supplemental Terms conflict with Apple's Standard EULA concerning the App Store license or Apple's rights and obligations, Apple's Standard EULA controls.
Acceptance
The app presents these Supplemental Terms when you first set it up; continuing past that notice signifies your agreement, and the app records the version you accepted. Using the app or this website after notice of these terms also signifies agreement. If you do not agree, do not use the app.
Eligibility
You must be at least 18 years old to agree to these terms, or use the app under the supervision of a parent or legal guardian who agrees to them on your behalf.
What Yip is for
Yip is intended only for humane, reward-based training of a dog lawfully under your care or control — and, where you are not the owner, only with the owner's permission. A cue works because it predicts something good. That is the entire mechanism, and it is the only use this app is built for.
Acceptable use — train kindly, or not at all
Animals are extremely sensitive to sound. Dogs hear quieter, higher, and farther than people do. A sound tool misused is not training — it is harassment. By using Yip you agree NOT to use it:
— to annoy, tease, startle, punish, or harass any animal;
— on or at any person, or to target, frighten, distract, or influence
another person's animal;
— as a deterrent, repellent, punishment, or "bark control" device — such
use is inconsistent with Yip's purpose and with the American Veterinary
Society of Animal Behavior's published recommendation that only
reward-based methods be used in dog training (AVSAB is not affiliated with
and does not endorse Yip or Mosaic Paradigm LLC);
— on animals not lawfully under your care or control, on wildlife, or on
livestock you have no business with;
— at close range to any animal's or person's ear, at maximum level for
sustained periods, or on an animal showing any sign of fear, discomfort,
avoidance, agitation, pain, or distress — including but not limited to
freezing, cowering, repeated lip-licking, a tucked tail, attempts to hide,
or attempts to leave;
— through external speakers, amplifiers, public-address systems,
headphones placed near an animal, or any other equipment that can increase
or concentrate the output, and never by bypassing or attempting to
override the app's audio limits;
— in any way that violates animal-welfare law where you are, or where
producing the sound could create a foreseeable safety risk.
We may decline support relating to use that violates these terms. Nothing in these terms requires us to investigate suspected misuse.
Sound-use precautions
Begin with the lowest volume that could work and use brief cues. Increase volume only when reasonably necessary and never to provoke a reaction; do not repeatedly play tones at an animal that does not respond — a lack of obvious reaction does not establish that a sound is safe or comfortable. Never place the device against or immediately beside an animal's or person's ear, and do not test a tone by holding the speaker near one. Stop immediately if any person or animal appears uncomfortable or distressed. Do not operate Yip while driving, cycling, or doing anything where it would distract you from controlling or supervising the dog.
Sound output — honestly stated
Yip uses conservative software-level output settings and defaults, and its interface is designed not to offer frequencies outside the device speaker's nominal range. However, Yip cannot measure or guarantee the volume, frequency response, or sound pressure produced by your device or reaching an animal: actual output varies by device, settings, connected audio equipment, distance, and surroundings. Device speakers differ in frequency response and may distort, attenuate, or fail to reproduce a selected frequency; a frequency shown in the app is a requested digital setting, not a guarantee of the precise sound a particular device produces.
Not an emergency or safety device
Yip is not an emergency, tracking, containment, or safety device. Do not use it as a substitute for a leash, secure enclosure, identification tag, microchip, physical supervision, or professional assistance. A recall can fail — any recall, trained by any method. Keep your dog leashed where the law or the situation requires it, and never rely on a recall cue near roads, livestock, wildlife, or other hazards.
Not professional advice
The built-in training material is supplementary, general guidance that ships alongside the tools — the product is the whistle and the clicker. Use the guides as much or as little as suits you and your dog.
Yip is a training tool, not a trainer. Nothing in the app or on this site is veterinary, behavioral, or other professional advice. For health concerns, aggression, anxiety, or any serious behavioral issue, consult a qualified veterinarian or a certified trainer or behaviorist. The app's training content describes common, widely used techniques; whether and how to use them with your dog is your decision and your responsibility.
No guarantee of results
Training outcomes depend on the dog, the handler, consistency, and circumstances. We make no promise that your dog will learn, respond to, or keep responding to any cue. Progress numbers shown in the app describe your logged sessions; they are not a prediction.
Your responsibility
You are responsible for your dog's behavior, for the sound you put into the world around you, and for complying with local laws (leash laws, noise rules, animal-welfare law) at all times.
Ownership
Yip, including its software, interface, illustrations, built-in whistle patterns and training content, trademarks, and this website, is owned by Mosaic Paradigm LLC or its licensors and is protected by intellectual property law. These terms grant you no rights in it beyond the app license described above.
Your recordings
You keep whatever rights you have in sounds you record or cues you create in Yip. You agree not to record, import, or use audio that infringes anyone's copyright, privacy, publicity, or other rights.
Purchases and refunds
Purchases are made through Apple's App Store and are administered by Apple, subject to Apple's rules and applicable law. Refund requests are decided by Apple through its processes.
The app is provided "as is"
To the maximum extent permitted by law, the app and this website are provided "as is" and "as available", without warranties of any kind, express or implied — including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted or error-free, or that any sound will reproduce identically on every device.
Limitation of liability
To the maximum extent permitted by applicable law, Mosaic Paradigm LLC will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising out of or relating to Yip.
To the maximum extent permitted by applicable law, Mosaic Paradigm LLC's aggregate liability for all other claims arising out of or relating to Yip will not exceed the greater of fifty U.S. dollars (US$50) or the amount you paid for the app.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited — including liability for fraud, willful misconduct, gross negligence where it cannot be limited, or violation of applicable law.
Except to the extent such responsibility cannot legally be excluded, Yip is not responsible for injury, escape, loss, damage, or other consequences resulting from reliance on a sound cue, failure to use appropriate physical control, misuse of the app, use contrary to these terms, or use with external amplification or routing.
Changes
We may update these terms as Yip evolves. Changes apply prospectively from the revised effective date and do not alter the terms governing a dispute that arose before that date. We will provide reasonably conspicuous notice of material changes through the app, this website, or the App Store update information — and where required by law, we will request your affirmative acceptance before materially revised terms apply to you. Once revisions begin after launch, previous versions will remain available on this website.
Governing law
These Supplemental Terms are governed by the law of the U.S. state in which Mosaic Paradigm LLC is organized, without regard to conflict-of-law rules, except where the law of your place of residence grants you mandatory consumer rights or requires otherwise.
General
These Supplemental Terms, Apple's Standard EULA, and the Privacy Policy are the entire agreement about the app and this website. If any provision is found unenforceable, it will be narrowed or severed and the rest remain in effect; our not enforcing a term is not a waiver of it. Mosaic Paradigm LLC may assign this agreement in connection with a merger, acquisition, asset sale, or corporate reorganization. Ownership, disclaimers, limitations of liability, and dispute provisions survive any termination.
